Placing an order constitutes the Client\u2019s unconditional acceptance of these terms.<\/p>\n<\/header>\n<div class=\"bmi-en-note\"><strong>English information version \u2014 updated 28 August 2026.<\/strong> Transactions remain governed by French law. If a discrepancy affects the interpretation of a statutory or contractual provision, the French version in force on the order date and mandatory French law prevail.<\/div>\n<section>\n<h2>Seller<\/h2>\n<p>Roudey International \/ Marbre Import, SARL, registered with the Paris Trade and Companies Register under number 532 254 315, registered office at 118\u2013130 Avenue Jean Jaur\u00e8s, 75171 Paris Cedex 19, France. Email: info@marbre-import.fr.<\/p>\n<\/section>\n<section>\n<h2>Article 1 \u2014 Definitions<\/h2>\n<p><strong>Client:<\/strong> any consumer, professional, natural person or legal entity entering into a contract with the Seller.<\/p>\n<p><strong>Delivery:<\/strong> the first presentation of the ordered Products at the delivery address provided during checkout.<\/p>\n<p><strong>Products:<\/strong> all goods offered through the online shop, including marble, natural stone and associated products.<\/p>\n<p><strong>Territory:<\/strong> continental France for orders completed directly through the online shop. Corsica, French overseas territories and every international destination require an individual transport quotation requested through the <a href=\"https:\/\/boutique.marbre-import.fr\/en\/contact\/\">contact form<\/a> and accepted by the Seller before an order is placed.<\/p>\n<\/section>\n<section>\n<h2>Article 2 \u2014 Scope and acceptance<\/h2>\n<p>These Terms and Conditions govern online purchases from boutique.marbre-import.fr. Before confirming an order, the Client must review the basket, product references, quantities, billing and delivery details, payment method, taxes and delivery charges.<\/p>\n<p>The Seller may refuse or suspend an order in the event of payment difficulty, suspected fraud, an unresolved previous dispute, product unavailability, delivery constraints or an obvious pricing or description error.<\/p>\n<\/section>\n<section>\n<h2>Article 3 \u2014 Product information and natural variation<\/h2>\n<p>Product descriptions provide the essential characteristics known at the time of publication. Photographs, samples and showroom displays indicate the general character of the material but cannot reproduce every possible variation.<\/p>\n<p>Natural stone may vary in colour, veining, crystallisation, pores, inclusions, texture, surface relief and markings. Differences may occur within one order, between production batches or between a sample and the delivered material. These natural characteristics do not constitute defects.<\/p>\n<p>Slate, sandstone, limestone and quartzite may show cleaving, relief and thickness variation. Travertine may contain cavities whose size, direction and filling vary. Handmade packing may cause minor surface marks of less than 1 mm. Natural materials may contain capillary fissures, weaker zones or colour changes inherent in their geological formation.<\/p>\n<p>Clients must order sufficient material for the complete project and allow for cuts, breakage, selection and wastage. A minimum allowance of 10% is recommended and may need to be increased according to layout and site conditions. For visually continuous areas, the full quantity should be ordered from one available batch wherever possible.<\/p>\n<\/section>\n<section>\n<h2>Article 4 \u2014 Dimensions, tolerances and installation<\/h2>\n<p>Normal professional tolerances apply. Unless a product specification states otherwise, indicative thickness tolerances are \u00b10.5 mm for tiles up to 1,000 cm\u00b2, \u00b11 mm for larger tiles and \u00b11.5 mm for slabs and worktops. Cleaved slate, quartzite and similar finishes naturally have more irregular thicknesses.<\/p>\n<p>Natural fissures, veins or voids may be resin-filled. These areas must be handled carefully during installation. The Client is responsible for selecting a competent installer, compatible adhesives and treatments, and a specification suited to the substrate, traffic, climate and intended use.<\/p>\n<\/section>\n<section>\n<h2>Article 5 \u2014 Ordering process and availability<\/h2>\n<p>Products are selected on the website and placed in the basket. The Client must provide all information required for payment, invoicing and Delivery and must confirm the order after reviewing the summary.<\/p>\n<p>For marble and natural stone, the minimum order may be one complete pallet or one complete crate where stated on the product page. Lots and crates are sold with the quantities and total surface areas shown on their individual product pages.<\/p>\n<p>Products remain subject to availability. If a Product becomes unavailable after ordering, the Seller will inform the Client and offer an alternative, partial fulfilment, revised timescale or refund of the unavailable item.<\/p>\n<\/section>\n<section>\n<h2>Article 6 \u2014 Prices<\/h2>\n<p>Prices displayed on the website are those applicable when the order is confirmed. Taxes, handling and optional services are shown during checkout where applicable.<\/p>\n<p><strong>Delivery prices displayed in the basket and at checkout apply exclusively to continental France.<\/strong> For Corsica, French overseas territories and every international destination, the Client must request an individual transport quotation through the <a href=\"https:\/\/boutique.marbre-import.fr\/en\/contact\/\">contact form<\/a> before ordering. A French delivery price may not be used for an international delivery.<\/p>\n<p>For marble lots, the stated price per square metre and the total lot price are based on the quantity allocated to that specific crate. The individual product page and order summary are authoritative.<\/p>\n<\/section>\n<section>\n<h2>Article 7 \u2014 Right of withdrawal<\/h2>\n<p>Where the Client is a consumer and no statutory exception applies, the Client has fourteen (14) days from physical receipt of the Product \u2014 or the last Product in a split order \u2014 to notify an unambiguous decision to withdraw under Article L.221-18 of the French Consumer Code.<\/p>\n<p>The notice must be sent before the deadline to Marbre Import, 118\u2013130 Avenue Jean Jaur\u00e8s, 75171 Paris Cedex 19, France, or info@marbre-import.fr. Products must then be returned without undue delay and no later than fourteen days after notification to: TRANSIT PLUS, 6 bis Rue Philippe Chevalier, 95420 Magny-en-Vexin, France.<\/p>\n<p>The Client bears the direct return cost. The Seller may withhold reimbursement until the Product has been received or proof of dispatch has been supplied, whichever occurs first. Reimbursement is made using the original payment method unless another method is expressly agreed.<\/p>\n<p>Subject to mandatory consumer law, the right of withdrawal does not apply to made-to-measure, cut-to-size, personalised or clearly bespoke Products. The French terms also state that complete clearance lots, end-of-line lots and lots sold with a specific commercial discount cannot be returned in whole or in part, except where mandatory statutory rights apply.<\/p>\n<\/section>\n<section>\n<h2>Article 8 \u2014 Payment<\/h2>\n<p>The Client warrants that they are authorised to use the chosen payment method. Payment information is securely transmitted to the relevant payment provider and is not processed directly by the shop.<\/p>\n<p>Online card payments are processed through Stripe. Klarna may offer deferred payment, payment in three or four instalments, or longer financing to eligible adult consumers resident in France, subject to Klarna\u2019s approval and separate terms. Credit must be repaid; Clients should check their repayment capacity before committing.<\/p>\n<p>If payment is refused, reversed or cannot be completed, the order may be cancelled automatically. For professional Clients, late payment gives rise without reminder to interest at three times the French statutory interest rate and, where applicable, the \u20ac40 fixed recovery charge under Article L.441-10 of the French Commercial Code.<\/p>\n<p>The French source also provides, where legally applicable, for a contractual penalty of 15.21% of the total amount due per day of delay, subject to a minimum of \u20ac50 per overdue invoice, and for additional documented recovery costs exceeding the fixed charge.<\/p>\n<\/section>\n<section>\n<h2>Article 9 \u2014 Evidence and archiving<\/h2>\n<p>Contracts corresponding to qualifying orders are archived for ten (10) years in accordance with Article L.213-1 of the French Consumer Code. Electronic records, order confirmations and payment data may be used as evidence of the transaction.<\/p>\n<\/section>\n<section>\n<h2>Article 10 \u2014 Retention of title and transfer of risk<\/h2>\n<p>The Products remain the Seller\u2019s property until all sums due have been paid in full. For consumer sales, risk transfers when the Client or a third party appointed by the Client, other than the carrier proposed by the Seller, physically receives the Products, subject to mandatory law.<\/p>\n<\/section>\n<section>\n<h2>Article 11 \u2014 Delivery<\/h2>\n<p>Available online delivery methods, estimates and charges apply only to continental France. The checkout removes French delivery rates and prevents completion of an order when the delivery address is in Corsica, a French overseas territory or another country. The Client must first request and accept an individual transport quotation through the <a href=\"https:\/\/boutique.marbre-import.fr\/en\/contact\/\">contact form<\/a>. Preparation times exclude weekends and public holidays. The maximum delivery period stated in the French terms is seventy (70) days unless another timescale is agreed or mandatory law provides otherwise.<\/p>\n<p>The Client must provide an accurate address, telephone number and accessible delivery location. Pallet deliveries require access suitable for a vehicle of up to 19 tonnes, depending on order weight. Delivery is by appointment, normally to ground level or the nearest safe accessible point. The carrier is not required to carry Products inside a home, upstairs or to unpack them.<\/p>\n<p>A change of address after dispatch, an unattended appointment, unsuitable access, refusal of Delivery or a second journey may result in additional transport, waiting-time, handling or storage charges. If a collection order is not collected within thirty (30) calendar days after being made available, the French terms provide for storage charges of \u20ac372 including VAT per month.<\/p>\n<\/section>\n<section>\n<h2>Article 12 \u2014 Packaging<\/h2>\n<p>Products are packed in accordance with the transport requirements considered appropriate for their nature, weight and destination. Crates and pallets must be handled with suitable equipment and by competent personnel.<\/p>\n<\/section>\n<section>\n<h2>Article 13 \u2014 Inspection, claims and statutory warranties<\/h2>\n<p>Before signing the delivery note, the Client must inspect the Delivery in the carrier\u2019s presence, check quantities and references, and look for visible damage. The wording \u201csubject to unpacking\u201d alone has no legal value. Any irregularity should be described precisely on the delivery note and the goods should be refused where necessary.<\/p>\n<p>Transport damage or partial loss must be notified to the carrier by registered letter within three (3) days, without prejudice to mandatory rights. The Seller should also be contacted immediately with photographs and the order reference.<\/p>\n<p>Consumers benefit from the statutory conformity warranty under Articles L.217-3 et seq. of the French Consumer Code, including the applicable two-year period, and from the warranty against hidden defects under Articles 1641\u20131648 of the French Civil Code. These statutory warranties apply independently of any commercial warranty.<\/p>\n<p>Improper handling, unsuitable installation, incompatible products, abnormal use, force majeure and natural characteristics described in Articles 3 and 4 are excluded to the extent permitted by law.<\/p>\n<\/section>\n<section>\n<h2>Article 14 \u2014 Liability<\/h2>\n<p>The Seller is not liable for non-performance attributable to the Client, including incorrect order details, unsuitable technical choices or improper installation. Where informed of the intended use, the Seller provides reasonable advice, but the Client and appointed professionals remain responsible for the final specification and site conditions.<\/p>\n<p>Subject to mandatory law, the Seller\u2019s warranty is limited to repair, replacement or reimbursement of the defective Products, as appropriate. The Seller is not liable for indirect loss or for third-party websites linked from the shop.<\/p>\n<\/section>\n<section>\n<h2>Article 15 \u2014 Force majeure<\/h2>\n<p>The Seller is not liable for delay or non-performance caused by an event beyond its reasonable control that could not reasonably have been foreseen or avoided, including cyberattack, infrastructure failure, shortage, interruption of communications networks, severe weather, strike or another event qualifying as force majeure under French law.<\/p>\n<p>If the impediment is temporary, performance is suspended. If it is permanent, the contract may terminate automatically in accordance with Articles 1351 and 1351-1 of the French Civil Code.<\/p>\n<\/section>\n<section>\n<h2>Article 16 \u2014 Personal data<\/h2>\n<p>Personal data is processed to manage accounts, orders, payment, invoicing, delivery, customer service, fraud prevention and legally permitted communications. Data may be shared with service providers involved in fulfilling the order and is retained as required for the contract and legal obligations.<\/p>\n<p>Clients may exercise their GDPR rights by contacting info@marbre-import.fr or writing to Marbre Import, 118\u2013130 Avenue Jean Jaur\u00e8s, 75171 Paris Cedex 19, France. Proof of identity may be requested where necessary.<\/p>\n<\/section>\n<section>\n<h2>Article 17 \u2014 Complaints and mediation<\/h2>\n<p>Customer service: +33 (0)9 72 15 80 01. Written complaints should be sent to Marbre Import, 118\u2013130 Avenue Jean Jaur\u00e8s, 75171 Paris Cedex 19, France, or info@marbre-import.fr.<\/p>\n<p>After first submitting a written complaint to the Seller, an eligible consumer may use the Seller\u2019s consumer mediator: M\u00e9diateur de la F\u00e9d\u00e9ration du Commerce et de la Distribution (FCD), 12 rue Euler, 75008 Paris, France \u2014 telephone +33 (0)1 44 43 99 00 \u2014 <a href=\"https:\/\/mediateur.fcd.fr\/\" rel=\"noopener\">mediateur.fcd.fr<\/a>.<\/p>\n<p>The former European Online Dispute Resolution platform was discontinued on 20 July 2025. General EU information about consumer redress is available at <a href=\"https:\/\/consumer-redress.ec.europa.eu\/\" rel=\"noopener\">consumer-redress.ec.europa.eu<\/a>.<\/p>\n<\/section>\n<section>\n<h2>Article 18 \u2014 Intellectual property<\/h2>\n<p>The website\u2019s visual, written, audio and technical elements are protected by copyright, trademark and other intellectual-property rights. Reproduction, framing, inline linking or other use without prior written permission is prohibited and may constitute infringement under the French Intellectual Property Code.<\/p>\n<\/section>\n<section>\n<h2>Article 19 \u2014 Severability<\/h2>\n<p>If a competent court or a change in law invalidates one provision, the remaining provisions continue in effect. Matters not expressly covered are governed by applicable French law and established trade practice, subject to mandatory consumer rules.<\/p>\n<\/section>\n<section>\n<h2>Article 20 \u2014 Amendments<\/h2>\n<p>The Seller may update these Terms and Conditions while the shop remains online. The version applicable to an order is the version in force when the order is placed. Later amendments do not apply retrospectively to Products already purchased.<\/p>\n<\/section>\n<section>\n<h2>Article 21 \u2014 Governing law and jurisdiction<\/h2>\n<p>These Terms and the relationship between the Client and Seller are governed by French law.
