Definitions

Client: any consumer, professional, natural person with legal capacity, or legal entity accessing or using the online shop.

Services: the information, online ordering, account, payment, delivery support, contact and other services made available through boutique.marbre-import.fr.

Content: all text, images, graphics, product information, videos and other elements published on the website.

Personal data: any information relating to an identified or identifiable natural person. “Personal data”, “data subject”, “processor” and “sensitive data” have the meanings given by Regulation (EU) 2016/679 (GDPR).

2. Website use

This website is an intellectual work protected by French intellectual-property law and applicable international regulations. Use of the website implies acceptance of this notice and the applicable terms. These documents may be amended at any time, and users should review them regularly.

The website is normally available at all times. Access may be interrupted for maintenance, security, infrastructure or technical reasons. Where reasonably possible, advance information will be provided for planned interruptions.

3. Information and services

The online shop presents marble, natural stone and associated products and enables eligible clients to place orders. Marbre Import endeavours to provide accurate and current information but cannot guarantee that all content is complete, error-free or permanently up to date.

Product photographs represent the general character of natural materials. Colour, veining, texture, pores, inclusions and markings vary between pieces and production batches. The product page, order summary, invoice and contractual documents take precedence over general website information.

4. Technical limitations and hosting

The website uses technologies including JavaScript. Marbre Import cannot be held liable for damage arising from outdated, incompatible or infected user equipment or software. The hosting provider may interrupt service for maintenance, infrastructure improvements, failures or abnormal traffic. Marbre Import and the hosting provider cannot be held liable for internet, telephone-network or equipment failures preventing access to the server.

5. Intellectual property

Marbre Import owns or holds the rights of use relating to the website’s text, photographs, graphics, logos, videos, icons, sound and other content. Reproduction, representation, modification, publication or adaptation, in whole or in part and by any process, is prohibited without prior written permission.

Unauthorised use may constitute infringement and may be pursued under Articles L.335-2 et seq. and L.713-1 et seq. of the French Intellectual Property Code.

6. Liability and external links

Marbre Import acts as website publisher and is responsible for the content it publishes, subject to the limits stated in this notice and mandatory law. It cannot be held liable for indirect loss, loss of opportunity, technical incompatibility or circumstances beyond its reasonable control.

The website may link to third-party websites. Marbre Import does not control those websites and cannot accept responsibility for their content, security or data practices. Interactive areas may be moderated, and unlawful, abusive, defamatory or infringing content may be removed without notice.

7. Personal data

7.1 Data controller

For personal data collected through accounts, orders, payments, contact forms and browsing, the data controller is Marbre Import, represented by Nicolas Roudey.

7.2 Purposes

Depending on the user’s relationship with Marbre Import, personal data may be processed to manage accounts, orders, invoicing, payment, delivery and customer service; prevent fraud and unauthorised access; improve the website; meet legal obligations; and send communications where legally permitted.

Marbre Import does not sell personal data. Data may be shared with authorised personnel and service providers solely where necessary for these purposes.

7.3 Your rights

Subject to applicable conditions, data subjects may exercise rights of access, rectification, erasure, withdrawal of consent, restriction, objection and portability under Articles 15–21 GDPR, and may give instructions regarding personal data after death as provided by French law.

7.4 Recipients and transfers

Marbre Import selects processors offering sufficient safeguards. Personal data will not be transferred outside the European Economic Area without appropriate information and safeguards required by applicable law.

8. Security and incident notification

Reasonable organisational and technical measures are used to protect data against loss, misuse, unauthorised access, disclosure, alteration or destruction. No internet transmission or electronic storage method is completely secure. If a personal-data breach is identified, affected persons and competent authorities will be notified where required by law.

9. Cookies and tracking technologies

The website may use cookies, analytics tags and similar technologies to operate the shop, remember choices, measure performance and improve navigation.
